Medical Marijuana Law in Washington
Patients in Washington who have been formally diagnosed with one or more qualifying health conditions may apply for and be registered for medical cannabis. Washington was among the first two states to legalize adult-use cannabis in November 2012, when voters approved I- 502. However, unlike most states that allow marijuana, Washington continues prosecuting adults for secretly cultivating a few plants at home. Legislators attempted to change this in 2021. After that, they introduced HB 1019, which would have legalized up to six plants per adult at home (no more than 15 plants per housing unit). The Washington Department of Health is in charge of statewide medical marijuana program policy, enforcement, and patient registration. The Marijuana Patient Protection Act (SB5052) was signed into law in April 2015 and went into effect on July 1, 2016. This legislation brings all cannabis producers, processors, and retailers under the jurisdiction of the Washington State Liquor and Cannabis Board. This includes medical cannabis dispensaries. It is by WAC 314-55-080 legislation, which was drafted to ensure that patients on low incomes are not exempt from using cannabis.
Cultivation of Marijuana in Washington
Growing marijuana at home is the most significant advantage of obtaining an MMJ license. A person may have six plants and eight ounces of usable cannabis in their home, and a healthcare doctor may authorize up to 15 plants. Parents who are so authorized may have up to 16 ounces of marijuana produced from their plants. Even if multiple qualifying parents or designated providers reside in the same housing unit, no more than 15 plants may be cultivated or located there.

Those listed in the state’s voluntary patient database are permitted to possess three ounces of usable cannabis, 48 ounces of cannabis-infused product to be eaten or swallowed in solid form, 21 grams of cannabis-infused extract or cannabis concentrate intended for inhalation, and 216 ounces of cannabis-infused product to be eaten or consumed in liquid form.
