Medical Marijuana Law in the Virgin Islands
Gov. Albert Bryan Jr. signed the Medicinal Marijuana Patient Care Act into law on January 19, 2019. The measure will establish a comprehensive medicinal marijuana program for the Virgin Islands residents and medical tourists. Marijuana has become legal for recreational use in the Virgin Islands since January 18, 2023.
The territory legislature passed legalizing measures in 2022, and it was signed into law on January 18, 2023.
Possession Limits of Marijuana in the Virgin Islands
- Registered patients who are VI citizens may possess up to 4 ounces of marijuana.
- One ounce of marijuana concentrate and 2 ounces of cannabis products.
- Patients with MMJ cards that allow them to cultivate marijuana may cultivate six flowering medical Cannabis plants and six Immature cannabis plants in a secure environment.
Eligibility For a Caregiver
Patients may appoint a carer to assist them with the medicinal use of cannabis. The Office of Cannabis Regulation gives caregivers MMJ cards and should meet the following requirements:
- Must be 21 or older.
- Caretakers may only help up to three patients, including oneself.
- Caregivers may pick up a patient’s marijuana from a licensed dispensary on their behalf.
- A patient may have more than one carer provided the patient presents documentation that more help is required due to health conditions.
- Plants can be cultivated by either the patient or their caretaker. Patients will notify the OCR if they or their caregivers will be selected to cultivate.
Some Important Information
Here are various restrictions and prohibitions for using marijuana in the Virgin Islands.
- Marijuana could not be smoked in any public or open-to-the-public area.
- A Licensed dispensary may only give three ounces of dried cannabis per patient every 14 days.
- While under the influence of cannabis, patients are not permitted to drive, operate a boat, train, or aircraft, or perform any work that would be professional misconduct.
- Medicinal marijuana companies that sell to non-cardholders face criminal charges and up to a year in prison.
- Landlords are not allowed to allow marijuana cultivation on their property.
- Cardholders who violate the law may have their Identity cards withdrawn or suspended and face criminal consequences.
