Utah Medical Cannabis Law
On November 6, 2018, Utah voters approved the Utah Medical Cannabis Act initiative, allowing patients with a physician’s recommendation to use medical cannabis. The law came into effect on December 1, 2018, but was quickly revised through HB 3001 to include more restrictions on patient access and a higher level of state oversight.
On February 28, 2020, Governor Herbert signed SB 121, which made a number of changes to the medical cannabis program, including allowing cannabis flowers to be dispensed in child-proof bottles, not just blister packs, allowing doctors to recommend more patients. Utah made medical cannabis even more readily accessible on March 24, 2020, when Governor Herbert signed HB 425 into law, which delayed the requirement that patients obtain an MMJ card until late 2020.
Caregivers
Patients may designate up to 2 caregivers to help with the access and use of medical cannabis. Caregivers are not permitted to cultivate cannabis.
Patient Possession Limits
Patients are permitted to possess the following limit of marijuana:
- A one-month supply at a medicinal marijuana pharmacy based on the dosage amount specified by their MMJ doctor or state-licensed pharmacist.
- For a patient,4 ounces of flower or 20 grams of THC are allowed. Marijuana can be prescribed as a flower or bud, tablets, capsules, concentrated oil, topicals, liquid suspension, transdermal patches, sublingual preparations, and lozenges.
- Patients are not allowed to grow their medicinal marijuana.
