Mississippi Medical Marijuana Law
On Jan. 26, 2022, the Mississippi Medical Cannabis Act, Senate Bill 2095, was passed by the legislature. The Mississippi Medicinal Cannabis Act (SB 2095), sponsored by Sen. Kevin Blackwell, received final approval from the Mississippi Legislature to restore voters’ will by establishing a medicinal marijuana program. Gov. Tate Reeves (R) signed the bill into law on February 2, 2022.
Possession and Purchase Limit
Possession and purchase limits are based on “Medical Cannabis Equivalency Units” of 3.5 grams of flower, up to 100 mg of THC in infused products, and one gram of concentrate.
- Patients can only purchase six MCEUs per week (21 grams or less than 3/4 ounce).
- Patients are permitted to purchase up to 24 MCEUs in a single month (84 grams, which is less than 3 ounces).
- At no time may a patient have more than 28 MCEUs (98 grams, less than 3.5 ounces).
Eligibility For a Primary Caregiver
Patients could appoint a caregiver to help them with medicinal marijuana use, such as picking up medicinal marijuana from a dispensary.
- Caregivers may help up to five patients.
- Caregivers must be 21 years old and cannot have certain prior criminal records.
- If a patient requires more than one caregiver, they must submit documentation illustrating that the patient’s age or medical condition necessarily requires the need for extra caregivers.
Cultivation of Medical Marijuana
House Bill 1309 is pending legislation that would allow qualified medical marijuana patients in Mississippi to grow up to six plants at a time in their own homes if the cultivation of medical marijuana is legalized.

A patient over the age of 18 who is applying for a medical cannabis card in Mississippi will need the following:
