Marijuana in Arizona

Arizona is surprisingly different from other states in the U.S. because weed is legal here for medical and recreational purposes. Albeit, the regulations vary vastly from medical marijuana to recreational weed.

Legality

In 2010, voters in Arizona consented Prop 203, Arizona Medical Marijuana Act (AMMA) through which it was made eligible for Arizonians to consume marijuana within limits posed by the state legislation. The Arizona Department of Health Services (AZDHS) is responsible for regulating medical marijuana in the state.
In 2020, Arizona legalized the use of weed for recreational purposes, however, it was with restrictions on usage, purchase, sale, and possession.

Qualifying Medical Conditions

To apply for an Arizona Medical Cannabis Card, you must have one of these medical conditions:

  • Agitation of Alzheimer’s disease
  • Amyotrophic Lateral Sclerosis (ALS)
  • Any chronic or debilitating medical condition, or disease, or treatment for one that causes cachexia or wasting syndrome
  • Cancer
  • Chronic pain, such as from migraines or arthritis
  • Crohn’s disease
  • Glaucoma
  • HIV or AIDS
  • Hepatitis C
  • Post-traumatic stress disorder (PTSD)
  • Severe nausea
  • Severe or persistent muscle spasms, such as those associated with multiple sclerosis
  • Seizures, including from epilepsy

Benefits

  1. Taxation – Medical Marijuana patients are credible to pay only state and local taxes but are exempt from any excise tax. At current tax rates, approximately 8% in taxes contribute to medical marijuana purchases.
  2. Dosage – The AZDHS demands no potency limits on medical marijuana purchases.
  3. Legal – Qualifying patients or caregivers are protected under the Arizona medical cannabis card policies from all the permitted criminal penalties.
  4. Employment – Arizona does not allow any workplace discrimination against medical marijuana card-holding consumers while hiring or firing.

Reciprocity

The Arizona Medical Marijuana Act provides limited reciprocity to visiting qualifying patients. To be one, the patient:

  • Must not be a resident of Arizona (or has resided in Arizona for less than 30 days).
  • Must have been diagnosed with a medical condition recognized by AZDHS.
  • Must possess a medical marijuana registration card or its equivalent that was issued obliging to the laws of another state.

The Final Note!

All cardholders (Patients, Caregivers, Dispensary/Lab Agents) that currently hold a valid physical card will still be able to use it until its expiration date when it is lost/stolen, or until a card change is requested. Once any of these things occur, a new electronic card will be issued on/after Dec. 1, 2019. Thus, it is best advised to apply for your electronic Arizona Medical Cannabis Card right away!
